1. ការទទួលយកលក្ខខណ្ឌ

By registering a workspace account, accessing the web portal, using mobile site report submission, or clicking "Create Workspace", you affirm that:

• You are at least 18 years of age and possess legal capacity to enter into binding contracts;
• If acting on behalf of an architectural firm, engineering consultancy, general contractor, or corporate entity, you possess full corporate authorization to bind that organization to these terms;
• You agree to comply with all applicable laws of the Kingdom of Cambodia, including commercial and electronic transaction statutes.

If you do not agree to all terms and conditions set forth herein, you must immediately discontinue use of the platform and cancel any active workspace subscriptions.

2. គណនី និងតួនាទីក្នុងកន្លែងធ្វើការ

Architechain operates on an organizational workspace model with granular Role-Based Access Control (RBAC):

• Workspace Administrator: The account creator is designated as primary administrator and is responsible for managing billing, adding or removing team seats, and configuring workspace permissions.
• Department Roles: Team members assigned to Architecture, Quantity Surveying (QS), Construction Site Operations, Finance, or Management must each maintain individual credential security. Account sharing between multiple individuals is strictly prohibited.
• Client Portal Access: When granting external property owners or clients view-only access to quotations or progress milestones, the workspace owner remains fully liable for all data shared.
• Credential Protection: You are solely responsible for safeguarding your login credentials. Notify us immediately at support@architechain.com if you suspect any unauthorized access to your workspace.

We offer flexible subscription plans tailored to independent architects, boutique studios, and large construction contractors:

• Annual Discounts: Subscriptions paid annually in advance receive discounted platform pricing as advertised on the checkout screen.
• Refund Policy: Because cloud server allocations, storage quotas, and automated report dispatch take effect immediately, fees are non-refundable, except where mandatory consumer protection statutes of Cambodia require otherwise.
• Plan Switching: You may upgrade your plan at any time with prorated adjustments. Downgrades take effect at the conclusion of the current prepaid billing period.

4. កម្មសិទ្ធិបញ្ញា និងភាពជាម្ចាស់

Platform Proprietary Rights: Architechain, its underlying software architecture, database design, user interface assets, algorithms, documentation, and the Architechain brand identity are the exclusive intellectual property of Architechain. You may not copy, reverse engineer, decompile, or create derivative works from the platform codebase.

You agree to use Architechain solely for legitimate architecture, engineering, and construction management purposes. You explicitly agree not to:

• Attempt to access workspaces, tenant records, or project folders that do not belong to your company;
• Upload viruses, trojan horses, malware, ransomware, or scripts intended to disrupt platform servers;
• Engage in automated scraping, stress testing, penetration testing, or denial-of-service (DoS) attacks against our infrastructure without prior written authorization;
• Store or transmit defamatory, fraudulent, infringing, or unlawful materials;
• Resell, white-label, or sublicense the SaaS platform to outside third parties without an active Enterprise Partner Agreement.

7. Telegram និងសេវាកម្មភាគីទីបី

Our platform offers optional integrations with external networks to automate project delivery:

• Telegram Bot Automation: Daily construction logs and instant notifications can be dispatched to your team's designated Telegram chat or group. You are responsible for ensuring that only authorized team members have access to the destination Telegram chat.
• Third-Party Availability: We are not responsible for delivery latency or service interruptions caused by third-party providers such as Telegram, Google OAuth, or telecommunications carriers.
• V.WorkDesk Free Tools: Lightweight standalone utilities (e.g. CAD viewers, unit converters, invoice templates) are offered "as is" and may be modified or retired at our discretion.

8. កម្រិតសេវាកម្ម និងការថែទាំ

We strive for continuous, uninterrupted operation with a target service availability of 99.5% uptime:

• Maintenance Windows: Routine security updates and feature deployments are scheduled during off-peak hours (between 01:00 AM and 04:00 AM Asia/Phnom_Penh) whenever feasible.
• Disaster Recovery: Encrypted multi-location database snapshots are executed daily to safeguard against catastrophic hardware failures.
• Force Majeure: Neither party shall be liable for delays or non-performance caused by events beyond reasonable control, including internet backbone outages, power blackouts, natural disasters, or telecommunication regulatory blockades.

9. ការព្យួរ និងការបញ្ចប់គណនី

Termination by You: You may cancel your workspace subscription at any time via your account Settings. Your access will continue until the end of your current prepaid billing cycle.

Suspension by Us: We reserve the right to temporarily suspend or permanently terminate workspace access immediately and without prior notice in the event of:

• Severe violation of our Acceptable Use Policy;
• Fraudulent payment chargebacks or failure to settle overdue subscription fees;
• Compliance with lawful court orders or directives issued by competent Cambodian authorities;
• Imminent threat to the security or stability of the multi-tenant cloud infrastructure.

Upon account termination, you are provided thirty (30) days to export all project drawings and reports, after which all tenant data will be permanently deleted from active systems.

10. កម្រិតនៃការទទួលខុសត្រូវ

To the maximum extent permitted by applicable law:

• No Indirect Damages: In no event shall Architechain, its directors, employees, or partners be liable for any indirect, incidental, special, exemplary, or consequential damages, including loss of profits, construction delays, structural damage, liquidated damages on client contracts, or loss of goodwill.
• Total Liability Cap: Our total cumulative liability arising out of or related to these terms or your use of the platform shall not exceed the total subscription fees actually paid by you to Architechain in the twelve (12) calendar months preceding the claim.

11. ច្បាប់គ្រប់គ្រង និងយុត្តាធិការ

These Terms of Service and any dispute, controversy, or claim arising out of or relating to them shall be governed by and construed in accordance with the substantive laws of the Kingdom of Cambodia.

The parties agree to attempt in good faith to resolve any dispute through amicable business negotiation. Should negotiations fail within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of Phnom Penh, Cambodia.
